Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ToFlintzani (the “Service”), a coffee-cup fortune-reading experience operated by GuestCaddy LLC (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Entertainment only

ToFlintzani is provided strictly for entertainment purposes. The readings, messages, and any content generated by the character “Yiayia Chrisoula” are works of fiction produced by automated systems. They are not advice of any kind — not medical, legal, financial, psychological, or professional advice — and must not be relied upon as such. You should never make, or refrain from making, any decision based on a reading. Any action you take based on the Service is taken at your own risk, and you assume all responsibility for it.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service or make any purchase. By using the Service you represent that you meet this requirement. The Service is not directed to children.

3. Accounts and sign-in

The Service uses passwordless “magic link” sign-in tied to your email address. You are responsible for maintaining access to the email account you use and for all activity that occurs under your account. Provide an accurate email address and keep your account secure.

4. Credits, pricing, and payments

The Service uses a prepaid credit system. Credits are a limited, non-transferable digital entitlement used to unlock certain features (for example, a full digital reading costs 1 credit and a real-cup photo reading costs 3 credits). Credit prices and pack contents are shown in the Service and may change over time.

Credits have no cash value, are not currency, cannot be redeemed for money, and are non-transferable except through features we may expressly provide. Payments are processed by our third-party payment processor, Stripe; your purchase may appear on your statement under a GuestCaddy-related descriptor. By purchasing, you authorize the applicable charge.

5. Refunds

Because credits unlock digital content that is delivered immediately, credits are generally non-refundable once used. Unused credits may be eligible for a refund at our discretion if requested within [REFUND WINDOW, e.g. 14] days of purchase. To request a refund, contact us at [CONTACT EMAIL]. Nothing in this section limits rights you may have under applicable consumer-protection law.

6. Your photos and content

If you upload a photograph of a coffee cup, you represent that you have the right to do so and that it does not contain unlawful content or the personal information of others without their consent. You grant us a limited license to process your image solely to generate your reading. Your photo is sent to our AI provider to produce the reading and is not stored by us after processing, as described in our Privacy Policy.

7. Acceptable use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to access, probe, or disrupt the Service, its security, or its infrastructure; (c) use automated means to access the Service or to generate readings at scale; (d) resell, redistribute, or commercially exploit the Service or its output; or (e) upload content that is illegal, harmful, or infringing.

8. Intellectual property

The Service, including its design, text, the “Yiayia Chrisoula” character, logos, and all related materials, is owned by GuestCaddy LLC or its licensors and is protected by applicable laws. These Terms do not grant you any ownership rights.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. READINGS HAVE NO PREDICTIVE OR FACTUAL VALUE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUESTCADDY LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM, OR (B) US $50.

11. Indemnification

You agree to indemnify and hold harmless GuestCaddy LLC and its officers, members, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Changes and termination

We may modify the Service or these Terms at any time; material changes will be reflected by updating the “Last updated” date above. We may suspend or terminate access to the Service, or to any account, at our discretion, including for violations of these Terms.

13. Governing law

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located in [COUNTY/STATE] for any dispute not subject to arbitration or small-claims resolution.
